General Terms and Conditions of Sale  

 

Between the seller [name and address], registered under SIRET number 83836382800032, located at "lieu-dit Les Estrades - 12560 Campagnac - France", represented by Mrs. Laurie CAUSSE, in her capacity as manager, duly authorized for the purposes hereof.  

Hereinafter referred to as the "Seller" or the "Company."  

On the one hand,  

And the individual or legal entity purchasing products or services from the company,  

Hereinafter referred to as the "Buyer" or the "Client."  

On the other hand,  

The following has been set forth and agreed upon:  

 

Article 1: Purpose and General Provisions  

These General Terms and Conditions of Sale determine the rights and obligations of the parties in the context of the online sale of products offered by the Seller.  

These General Terms and Conditions of Sale (GTCS) apply to all sales of products made through the Company's websites, which are an integral part of the contract between the Buyer and the Seller. The Seller reserves the right to modify these terms at any time by publishing a new version on its website. The GTCS applicable at the time of payment (or the first payment in the case of multiple payments) of the order will apply. These GTCS are available on the Company's website at the following address: https://ptitsloustics/cgv. The Company ensures that their acceptance is clear and without reservation by implementing a checkbox and a validation click. The Client declares having read all of these General Terms and Conditions of Sale and, if applicable, the Specific Terms and Conditions of Sale related to a product or service and accepts them without restriction or reservation. The Client acknowledges having received the necessary advice and information to ensure that the offer meets their needs. The Client declares that they are legally capable of entering into a contract under French law or validly representing the individual or legal entity for whom they are acting. Unless proven otherwise, the information recorded by the Company constitutes proof of all transactions.

 

Article 2: Prices  

The prices of the products sold through the Company's websites are indicated in Euros, including all taxes (TTC), and are precisely determined on the product description pages. Customs duties or other local taxes, import duties, or state taxes may be required in certain cases. These duties and amounts do not fall within the Seller's responsibility and will be the Buyer's responsibility (declarations, payment to the competent authorities, etc.). The Seller invites the Buyer to inquire about these matters with the appropriate local authorities. The telecommunications costs required to access the Company's websites are borne by the Client. Delivery costs, if any, are also borne by the Client.

 

Article 3: Conclusion of the Online Contract  

The Client must follow a series of specific steps for each product offered by the Seller to complete their order. However, the following steps are systematic:  

➢ Information on the essential characteristics of the product;  

➢ Choice of the product, if applicable, of its options, and indication of the Client's essential data (identification, address...);  

➢ Acceptance of these General Terms and Conditions of Sale;  

➢ Verification of the order details and, if necessary, correction of errors;  

➢ Follow the payment instructions and pay for the products;  

➢ Delivery of the products.  

The Client will then receive confirmation by email of the payment for the order, along with an acknowledgment of receipt of the order confirming it. They will also receive a .pdf copy of these general terms and conditions of sale. For delivered products, delivery will be made to the address provided by the Client. For the successful completion of the order, and in accordance with Article 1316-1 of the Civil Code, the Client agrees to provide truthful identification information. The Seller reserves the right to refuse the order, for example, for any abnormal request made in bad faith or for any legitimate reason.

 

Article 4: Products and Services  

The essential characteristics of the goods, services, and their respective prices are made available to the Buyer on the Company's websites. The Client acknowledges having received a detailed overview of the delivery costs as well as the payment, delivery, and contract execution terms. The Seller undertakes to honor the Client's order within the limits of available product stocks only. If not, the Seller will inform the Client. These contractual details are presented in detail and in French. In accordance with French law, they are subject to a summary and confirmation when the order is validated. The duration of the product offer and their prices is specified on the Company's websites, as well as the minimum duration of the contracts offered when they relate to continuous or periodic supply of products or services. Unless otherwise specified, the rights granted under these terms are exclusively for the individual signing the order (or the holder of the email address provided). In accordance with legal provisions on conformity and hidden defects, the Seller will refund or exchange defective products or those that do not match the order. Article 5: Retention of Title  

The products remain the property of the Company until full payment is made.

 

Article 6: Delivery Terms  

Products are delivered to the delivery address indicated during the order process and within the specified time frame. This time frame does not include the order preparation time. In case of a delivery delay, the Client may terminate the contract under the conditions defined in Article L 138-2 of the Consumer Code. The Seller will then refund the product and the "outbound" shipping costs in accordance with Article L 138-3 of the Consumer Code. The Seller provides a contact form to ensure customer service follow-up. The Seller reminds the Client that once the Client takes physical possession of the products, the risk of loss or damage to the products is transferred to them. It is the Client's responsibility to notify the carrier of any reservations regarding the delivered product.

 

Article 6-2: Delivery Times  

The processing time for your parcels is 1 to 3 business days, in addition to shipping times.

 

Article 7: Availability and Presentation  

Orders will be processed within the limits of available stocks or subject to available stocks from our suppliers. In case of unavailability of an item for more than 100 business days, you will be immediately informed of the expected delivery times, and the order for that item can be canceled upon request. The Client may then request a refund.

 

Article 8: Payment  

Payment is required immediately upon order, including for pre-order products. The Client can make the payment by credit card or via the Paypal solution. Cards issued by banks domiciled outside France must be international credit cards (Mastercard or Visa). Secure online payment by credit card is provided by our payment provider. The information transmitted is encrypted according to best practices and cannot be read during network transport. Once the payment is initiated by the Client, the transaction is immediately debited after verification of the information. In accordance with Article L. 132-2 of the Monetary and Financial Code, the payment commitment made by card is irrevocable. By providing their banking information during the sale, the Client authorizes the Seller to debit their card for the amount relating to the price indicated. The Client confirms that they are the legal owner of the card to be debited and that they are legally entitled to use it. In case of error or inability to debit the card, the Sale is immediately and automatically terminated, and the order is canceled.

 

Article 9: Right of Withdrawal  

In accordance with Article L. 121-20 of the Consumer Code, "the consumer has fourteen clear days to exercise their right of withdrawal without having to justify reasons or pay penalties, except for return costs, if applicable."  

The right of withdrawal can be exercised by completing the return form.  

When the right of withdrawal is exercised, we will refund the Buyer the total amount paid, including delivery costs. The products must be returned in their original condition and complete (packaging, accessories, without odors...) so they can be resold as new.

 

Article 10: Warranties  

In accordance with the law, the Seller assumes two guarantees: of conformity and against hidden defects of the products. The Seller will refund or exchange defective products or those that do not correspond to the order placed. The Buyer must first prove the nature of the defect for the refund request to be accepted. Article 11: Claims

Article 12: Intellectual Property Rights  

Trademarks, domain names, products, software, images, videos, texts, or generally any information subject to intellectual property rights are and remain the exclusive property of the Seller. No transfer of intellectual property rights is made through these GTCS. Any total or partial reproduction, modification, or use of these assets for any reason whatsoever is strictly prohibited.

 

Article 13: Force Majeure  

The Seller's obligations under these terms are suspended in the event of an unforeseeable circumstance or force majeure that prevents their execution. The Seller will notify the Client of the occurrence of such an event as soon as possible.

 

Article 14: Nullity and Modification of the Contract  

If one of the provisions of this contract is invalidated, this nullity shall not result in the nullity of the other provisions, which will remain in force between the parties. Any contractual modification is only valid after a written and signed agreement between the parties.

 

Article 15: Personal Data Protection  

In accordance with the French Data Protection Act of January 6, 1978, you have the rights of inquiry, access, modification, opposition, and rectification of personal data concerning you. By accepting these general terms and conditions of sale, you consent to

 

 our collecting and using these data for the performance of the present contract. By entering your email address on one of the sites in our network, you will receive emails containing information and promotional offers regarding products published by the Company and its partners. You may unsubscribe at any time. To do so, simply click on the link at the end of our emails or contact the data controller (the Company) by registered mail. We track traffic on all our sites using tools such as Google Analytics and other statistical tools.

 

Article 16: Applicable Law  

All the clauses in these general terms and conditions of sale, as well as all purchase and sale transactions mentioned therein, will be subject to French law.
